Welcome to Void Golf. "We", "us" and "our" mean Void Golf. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). Void Golf is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, and they cover warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to them, do not use or access the Services.

1. Access and account

By agreeing to these Terms you confirm that you are at least the age of majority in your state or province of residence, and that you consent to any minor dependents using the Services on devices you own, purchase or manage.

To use the Services — including browsing our store or buying anything — you may be asked to provide information such as your email address and billing, payment and shipping details. You represent and warrant that everything you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our products

We make every effort to represent our products accurately. Colors and appearance can still differ from what you see on screen, depending on your device and its settings.

We do not warrant that the appearance or quality of any product will meet your expectations or match how it is depicted in our store.

All product descriptions are subject to change at any time without notice, at our sole discretion. We may discontinue any product at any time, and we may limit the quantity of any product we offer to any person, geographic region or jurisdiction, case by case.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.

If we decline, change or cancel an order, we will try to reach you using the email address, billing address or phone number you gave us when you ordered.

Because every club is built to order, please review your order carefully before you submit it. Cancellations, returns and exchanges are handled under our Returns & Refund Policy, which sets out the window for each.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless you are buying under a wholesale arrangement we have agreed with you in writing. For wholesale enquiries, contact wholesale@voidgolf.com.

4. Prices and billing

Prices, discounts and promotions can change without notice. The price charged is the price in effect when you place the order, and it is set out in your order confirmation email. Unless we state otherwise, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices in our online store may differ from prices offered in physical stores or by third parties. We may run promotions governed by their own terms; where those conflict with these Terms, the promotion terms govern.

You agree to provide current, complete and accurate purchase, payment and account information, and to keep it up to date — including your email address, card numbers and expiry dates — so we can complete your transactions and reach you when we need to.

You represent and warrant that the payment information you provide is true, correct and complete; that you are authorized to use that payment method; that the charges you incur will be honored by your card issuer; and that you will pay those charges at the posted prices, including shipping, handling and any applicable taxes.

5. Shipping and delivery

Delivery times published anywhere in the Services, including in our Shipping Policy, are estimates only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer a product to the carrier, title and risk of loss pass to you. Shipping protection is available at checkout and is the fastest route to a resolution if a package is damaged or goes missing — see the Shipping Policy for how claims work.

6. Intellectual property

The Services — including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of all of it — are owned by Void Golf, its affiliates or its licensors, and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you a license or any other right under any patent, trademark, copyright or other intellectual property of Void Golf, Shopify or any third party, except as expressly stated. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted are reserved.

Void Golf's names, logos, product and service names, designs and slogans are trademarks of Void Golf or its affiliates or licensors, and you must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other marks on the Services belong to their respective owners.

7. Optional tools

You may be given access to third-party tools through the Services that we neither monitor nor control.

We provide access to those tools "as is" and "as available", without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third-party tools.

Any use of those tools is entirely at your own risk, and you should make sure you are familiar with and approve of the terms on which the relevant third party provides them.

We may offer new features and tools through the Services in future. Those are also part of the Services and are subject to these Terms.

8. Third-party links

The Services may contain material from, and links to, websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of third-party material or websites, and if you leave the Services to access them you do so at your own risk.

We are not liable for any harm or damage related to your use of third-party websites, or to your purchase or use of anything on them. Review the third party's policies before you transact with them, and direct any complaints, claims or questions about their products and services to them.

9. Relationship with Shopify

Void Golf is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Void Golf. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Void Golf, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Void Golf.

10. Privacy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services you acknowledge that you have read both.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify, and with third parties that may be located in countries other than where you live, in order to provide services to you. See our Privacy Policy for more on how we, Shopify and our partners use your personal information.

11. Feedback and reviews

If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, proposals, plans or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial use. We may use that license to operate, evaluate, improve and promote the Services and to meet our obligations under these Terms.

You represent and warrant that you own or have all necessary rights to your Feedback; that you have disclosed any compensation or incentive you received in connection with it; and that it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.

Your Feedback must not violate any third-party right, including copyright, trademark, privacy or personality rights. It must not be libelous, abusive, obscene or otherwise unlawful, and it must not contain any virus or malware. You may not use a false email address, pretend to be someone else, or otherwise mislead us or anyone else about the origin of your Feedback. You are solely responsible for your Feedback and its accuracy. We take no responsibility and assume no liability for Feedback posted by you or any third party.

12. Errors, inaccuracies and omissions

Information in the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any of them, and to change or update information or cancel orders where information is inaccurate, at any time and without prior notice — including after you have submitted an order.

13. Prohibited uses

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly:

  • for any unlawful or malicious purpose
  • to violate any international, federal, provincial, state or local law, rule, regulation or ordinance
  • to infringe our intellectual property rights or those of others
  • to harass, abuse, insult, harm, defame, slander, disparage or intimidate any of our employees or any other person
  • to transmit false or misleading information
  • to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms
  • to transmit or procure the sending of any advertising or promotional material, including junk mail, chain letters or spam
  • to impersonate or attempt to impersonate any other person or entity
  • to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that we determine may harm Void Golf, Shopify or users of the Services, or expose them to liability

You also agree not to:

  • upload or transmit viruses or any other malicious code that may affect the functionality or operation of the Services
  • reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services
  • collect or track other people's personal information
  • spam, phish, pharm or pretext the Services
  • use any robot, spider, scraper, data-gathering or extraction tool, or any automated or manual means, to access the Services, except for automated agents operating in full compliance with Section 14
  • interfere with, bypass or circumvent the security or authorization features, robot exclusion headers, or other measures we use to restrict access to the Services

We may suspend, disable or terminate your account at any time, without notice, if we determine that you have breached any part of these Terms.

14. Automated agents

14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, and that can run on behalf of or using a person's device without direct supervision.

14.2 No Agent may access, use or interact with the Services unless it identifies itself and operates in strict accordance with Section 14.4 at all times. No Agent may access the Services if we have asked it to stop.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.

14.4 Agents must:

  1. identify themselves in every HTTP/HTTPS request by including Agent/[agent name] in the request's user agent string
  2. not conceal or obfuscate that the activity comes from an Agent — including by mimicking human behavior and interaction patterns, or by completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans
  3. answer truthfully any question or prompt that seeks to determine whether the interaction is coming from a human or a computer
  4. not circumvent or avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services

15. Termination

We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion and at any time without notice. You remain liable for all amounts due up to and including the date of termination.

The following continue to apply after termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Disputes, Privacy, and General — along with any other provision that by its nature should survive.

16. Disclaimer of warranties

The information presented on or through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness or usefulness. Any reliance you place on it is strictly at your own risk, and we disclaim all liability arising from that reliance, whether by you or by anyone else who may be informed of its contents.

EXCEPT AS EXPRESSLY STATED BY VOID GOLF, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL VOID GOLF, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS ANY RIGHT YOU HAVE UNDER APPLICABLE CONSUMER PROTECTION LAW THAT CANNOT BE LIMITED BY AGREEMENT.

18. Indemnification

You agree to indemnify, defend and hold harmless Void Golf, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party and arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, though a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced by it. We may control the defense and settlement of a claim at your expense, including choice of counsel, but we will not settle any claim that imposes non-monetary obligations on you without your consent, which will not be unreasonably withheld. You will cooperate in the defense of indemnified claims, including by providing relevant documents.

19. Governing law and disputes

These Terms, and any separate agreement under which we provide you the Services, are governed by the laws of the State of California, without regard to its conflict of law rules.

You and Void Golf agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in San Diego County, California, and you and we consent to the personal jurisdiction and venue of those courts.

Nothing in this section deprives you of the protection of any mandatory consumer law of the country or state in which you live, or of your right to bring a claim in a small claims court where one is available to you.

Before filing anything, please talk to us. Most problems are faster to fix directly. Email support@voidgolf.com with a description of the issue and what you would like done about it, and we will try to resolve it with you.

20. Changes to these Terms

You can review the current version of these Terms on this page at any time.

We may update, change or replace any part of these Terms at our sole discretion by posting the update to our website. It is your responsibility to check periodically. We will notify you of material changes in accordance with applicable law, and those changes take effect on the date specified in the notice. Your continued use of the Services after changes are posted means you accept them.

21. General

Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is enforceable to the fullest extent permitted by law, and the unenforceable part is severed. The validity and enforceability of the remaining provisions is unaffected.

Waiver and entire agreement. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms, together with any policies or operating rules we post, are the entire agreement between you and us regarding the Services, and supersede any prior or contemporaneous agreements, communications and proposals, oral or written, including any previous version of these Terms. Ambiguities are not to be construed against the drafting party.

Assignment. You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.

Headings. Headings are for convenience only and do not limit or otherwise affect these Terms.
